Según Caracol Radio, la campaña ‘Ahora, por tus recargas te regalamos Facebook, Twitter y chat de WhatsApp’ vulneró los derechos de los consumidores por no haber dado detalles precisos sobre las condiciones y restricciones para esta promoción.
Como consecuencia de la falta de comunicación hacia los usuarios, estos tomaron su decisión de compra y eso es precisamente lo que castiga la ‘Súper’. Por tal razón, el mayor operador de telefonía móvil de Colombia deberá compensar a más de 1.300.000 usuarios.
Hay que recordar que Claro sacó nuevos productos al mercado luego de que la ‘Súper’ se pronunciara contra TigoUne por publicidad engañosa y en esa oportunidad Claro había dicho que todo estaba muy bien explicado respecto de sus planes de telefonía.
Un comunicado de la Superintendencia aclara que el operador no deberá pagar una multa por 10.000 millones de pesos, como incorrectamente informaba Pulzo en una versión anterior de esta noticia, pues ese dinero corresponde a una multa pasada.
A lo que están obligados, dice la ‘Super’, es a compensar a los usuarios con el acceso a la Red mencionado en el título de este artículo: “Los usuarios que entre agosto de 2015 y mayo de 2016 hicieron recargas con la expectativa de recibir el incentivo de chat de WhatsApp gratis serán los beneficiarios de esta medida”, anunció el ente de control.
Esta medida tendrá que cumplirse dentro de los 5 días hábiles siguientes
a la comunicación de la resolución, “para ser aprovisionados durante los siguientes 30 días calendario”, reza el comunicado.
